California Court Upholds Harvey Weinstein’s Conviction but Orders a New Sentencing Hearing.

A California appeals court has upheld Harvey Weinstein’s 2022 convictions for rape and sexual assault, rejecting his request for a new trial. However, the court ruled that the 16-year prison sentence imposed by the trial judge must be reconsidered, requiring a new sentencing hearing.

The three-judge panel concluded that Weinstein received a fair trial and found no constitutional violations during the proceedings. His attorneys had argued that jurors were unfairly influenced by information related to his overturned New York conviction and challenged several evidentiary rulings, but the court declined to overturn the guilty verdicts.

The resentencing order stems from the court’s finding that the original sentence may have relied on legal factors that are no longer valid, particularly after Weinstein’s earlier New York conviction was overturned. While his sentence will be reviewed, the convictions themselves remain fully intact.

Weinstein remains incarcerated and continues to face legal proceedings in New York, where prosecutors are seeking a lengthy sentence following a separate sexual assault conviction. His legal team has indicated it plans to continue appealing the California case.
