New court records have revealed the extent of Anna Duggar’s involvement in helping her husband, Josh Duggar, prepare the legal motion that sought to overturn his federal child sexual abuse material conviction.
According to documents obtained after the court’s ruling, Anna assisted Josh Duggar by helping draft, type, and organize the motion before it was ultimately rejected by a federal judge for being filed too late.
The filings show Josh, who is currently serving a 151-month federal prison sentence, exchanged handwritten and typewritten drafts of the motion with Anna through prison mail. After receiving the drafts, Anna reportedly transcribed the documents onto a computer and mailed completed copies back to her husband so he could review and sign them.
Court records also state Anna pre-filled the Certificate of Service date as June 24, 2025 — the final deadline for the motion to be submitted under federal rules.
Despite those efforts, the court determined the filing arrived well after the deadline. One copy reportedly reached the court clerk on July 29, 2025, more than a month late, while another version arrived even later.
Josh Duggar argued he should still qualify for protection under the federal “prison mailbox rule,” which can allow inmate filings to be considered timely if they are placed into a prison mailing system before the official deadline.
According to his testimony, Duggar claimed he prepared the envelopes after receiving the finalized paperwork from Anna and attempted to mail them before the cutoff date. He also said he obtained postage from another inmate and encountered issues with mailing costs before eventually sending the documents.
However, the court found inconsistencies in his explanation, including problems related to postmarked dates that appeared to contradict his account.
The judge ultimately ruled that Josh’s testimony was “not credible” and noted that Anna did not formally testify or provide sworn corroboration supporting his timeline of events.
“The Court can grant Mr. Duggar one coincidence,” the judge wrote in the ruling. “Perhaps even two or three odd happenstances. But Mr. Duggar is asking the Court to believe something akin to a magic bullet theory.”
Josh Duggar was arrested in 2021 and later convicted on charges involving the receipt and possession of child sexual abuse material. Since his conviction, he has filed multiple appeals and legal challenges, all of which have failed.
The former 19 Kids and Counting star is currently scheduled for release from federal prison in February 2033.
