Josh Duggar has filed another legal appeal in his ongoing effort to challenge his federal conviction, days after a judge rejected his previous attempt to move forward with the case.
The latest filing does not directly seek to overturn his conviction. Instead, Duggar is appealing the federal judge’s decision that dismissed his previous request, arguing that his legal challenge should have been allowed to proceed.
Duggar, who was convicted in 2021 of receiving and possessing material depicting minors engaged in sexually explicit conduct, is currently serving a 151-month federal prison sentence.
His new appeal focuses on the court’s decision that his previous filing was submitted too late under federal deadlines.
According to court documents, Duggar’s attorney filed the notice of appeal on June 15, challenging an order issued by a federal judge in Arkansas earlier this month.
The dispute centers around whether Duggar properly submitted his previous appeal paperwork on time.
Prosecutors argued that Duggar failed to meet the required deadline and therefore did not have legal standing to continue with the challenge. The court reviewed his claims that delays prevented the paperwork from reaching the court in time.
However, Judge Timothy Brooks rejected those arguments, saying the evidence did not support Duggar’s explanation.
The judge noted that the court did not receive the documents until weeks after the deadline, there was no supporting record showing the paperwork had been properly mailed from prison, and Duggar did not provide witnesses to confirm his version of events.
In his ruling, Judge Brooks described Duggar’s explanation as difficult to believe, writing that the series of events presented by Duggar required the court to accept “a sequential chain of events that defies common sense.”
The judge ultimately dismissed the case before allowing arguments about the substance of Duggar’s conviction.
Duggar is now asking a higher court to review that decision.
If he succeeds, it would not immediately erase his conviction or release him from prison. Instead, it would only allow his previous appeal seeking to challenge the conviction to move forward in federal court.
The original conviction came after prosecutors presented evidence that Duggar had downloaded and possessed illegal material involving minors. He was sentenced the following year and remains incarcerated.
Duggar is currently serving his sentence at a federal medical facility after a recent transfer from another federal prison.
His legal battles have continued years after the conviction, with his defense team repeatedly attempting to challenge aspects of the case.
The latest appeal represents another step in Duggar’s ongoing effort to reopen the legal process, while prosecutors continue defending the original conviction.
Duggar’s case has remained one of the most closely watched legal matters connected to the former reality television family, following years of public controversy surrounding allegations and criminal proceedings involving him.
